ARTICLE I: INTRODUCTION

Section 1.1 Overview

Fenceline, Inc. ("Fenceline," "Company," "we," "us," or "our") is committed to protecting the privacy of our users. This Privacy Policy ("Policy") describes how we collect, use, disclose, and protect personal information when you access or use our website located at https://fenceline.ai, our mobile applications, application programming interfaces ("APIs"), and all related services, features, content, and functionality (collectively, the "Platform" or "Services").

This Privacy Policy is incorporated into and made part of our Terms of Service. By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree to this Privacy Policy, you must not access or use the Platform.

Section 1.2 Scope

This Privacy Policy applies to all users of the Platform, including Contractors (home service professionals who use the Platform to operate their businesses), Customers (homeowners and property owners who use the Platform to obtain quotes and manage projects), and Suppliers (material suppliers who participate in the Fenceline Marketplace). Capitalized terms not defined in this Privacy Policy have the meanings set forth in our Terms of Service.

Section 1.3 Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. For material changes, we will provide at least thirty (30) days' advance notice by posting the revised Policy on the Platform and sending notice to the email address associated with your account. For non-material changes, we will post the revised Policy with an updated "Last Updated" date. Your continued use of the Platform after the effective date of the revised Policy constitutes your acceptance of the changes.


ARTICLE II: INFORMATION WE COLLECT

Section 2.1 Information You Provide

We collect information that you voluntarily provide when you register for an account, use our Services, or communicate with us.

2.1.1 Account Registration Information

When you create an account, we collect information necessary to establish and maintain your account, which may include:

  • Name and contact information (email address, phone number, mailing address)
  • Account credentials (username and password)
  • For Contractors: business name, business address, licensing information, service areas, insurance information, and tax identification numbers
  • For Suppliers: business name, business address, product categories, and tax identification numbers

2.1.2 Property and Project Information

When Customers use the Platform to design projects and obtain quotes, we collect:

  • Property addresses
  • Satellite imagery of properties (obtained from third-party providers based on provided addresses)
  • Fence designs, specifications, and configurations created using our estimation tools
  • Material selections and preferences
  • Project documents, including contracts, permits, photos, and related files

2.1.3 Communications

We collect the content of communications sent through the Platform, including:

  • Messages between Customers and Contractors
  • Emails integrated through Google email integration
  • SMS messages sent through the Platform
  • In-app chat communications
  • Communications with Fenceline support

2.1.4 Payment Information

When you make or receive payments through the Platform, we collect payment-related information, including billing address and payment method details. Note that full payment card numbers are collected and processed by our third-party payment processors and are not stored on Fenceline systems.

2.1.5 Contractor Business Data

Contractors who use the Platform for business management provide:

  • Customer relationship management (CRM) data
  • Project pipeline and status information
  • Team member information and organizational structure
  • Materials catalogs and pricing information
  • Invoices, quotes, and financial records
  • Scheduling and calendar information

2.1.6 Supplier Product Information

Suppliers who participate in the Marketplace provide:

  • Product catalogs, descriptions, and specifications
  • Pricing information, including volume discounts and tiered pricing
  • Inventory and availability data
  • Shipping and fulfillment information

Section 2.2 Information Collected Automatically

When you access or use the Platform, we automatically collect certain information about your device and usage.

2.2.1 Device and Technical Information

We collect technical information about the devices you use to access the Platform, including:

  • Device type, model, and operating system
  • Browser type and version
  • IP address
  • Unique device identifiers
  • Mobile network information

2.2.2 Usage Information

We collect information about how you interact with the Platform, including:

  • Pages and features accessed
  • Actions taken within the Platform
  • Date and time of access
  • Referring URLs and exit pages
  • Search queries within the Platform
  • Performance metrics and error logs

2.2.3 Location Information

We may collect location information, including:

  • Approximate location derived from IP address
  • Precise location from mobile devices (with your consent)
  • Location data associated with property addresses you provide

2.2.4 Cookies and Similar Technologies

We use cookies, web beacons, pixels, and similar technologies to collect information and provide functionality. These technologies help us:

  • Remember your preferences and settings
  • Authenticate your identity and maintain your session
  • Analyze Platform usage and performance
  • Deliver relevant content and advertising
  • Detect and prevent fraud and security threats

You can manage cookie preferences through your browser settings. Note that disabling certain cookies may affect Platform functionality.

Section 2.3 Information from Third Parties

We may receive information about you from third-party sources, including:

  • Satellite Imagery Providers: Property imagery and geographic data based on addresses you provide
  • Google Services: Information from integrated Google services (email, calendar) that you authorize
  • Payment Processors: Transaction confirmations and payment status
  • Integrated Business Systems: Data from accounting platforms (QuickBooks), CRM systems (Salesforce), and communication platforms (Slack) that you connect through our MCP integrations
  • Public Sources: Publicly available business information, such as licensing databases and business registrations

ARTICLE III: HOW WE USE INFORMATION

Section 3.1 Providing and Improving Services

We use collected information to provide, maintain, and improve the Platform, including:

  • Creating and managing user accounts
  • Enabling Customers to design projects, obtain quotes, and communicate with Contractors
  • Enabling Contractors to manage their businesses, including CRM, project management, and team coordination
  • Facilitating transactions between Contractors and Suppliers through the Marketplace
  • Processing payments and financial transactions
  • Providing customer support
  • Analyzing usage patterns to improve Platform features and performance

Section 3.2 AI-Powered Features

We use information to power AI features on the Platform, including:

3.2.1 RAG-Enabled AI System

Our Retrieval-Augmented Generation (RAG) enabled AI system processes Platform data—including projects, materials, customer information, and communications—to enable conversational interactions with business data, provide contextual insights, and deliver AI-powered business assistant features. Data processed by the RAG system is segregated by user; a Contractor's AI interactions will only access and reference that Contractor's own data.

3.2.2 Satellite Imagery Analysis

We use AI and computer vision technologies to analyze satellite imagery for fence layout design, measurement calculations, and project estimation.

3.2.3 SEO and Content Optimization

We use AI to provide automated SEO management, schema markup, keyword optimization, and performance monitoring for Contractor websites.

3.2.4 AI System Improvement

We may use anonymized and aggregated interaction data to improve our AI systems. Such aggregated data does not identify individual users.

Section 3.3 Communications

We use your contact information to:

  • Send account-related notifications (registration confirmations, password resets, security alerts)
  • Deliver service announcements and updates
  • Facilitate communications between Customers and Contractors
  • Send promotional materials and marketing communications (with your consent where required)
  • Respond to your inquiries and support requests

Section 3.4 Security and Fraud Prevention

We use information to protect the security and integrity of the Platform, including:

  • Detecting and preventing fraud, abuse, and security incidents
  • Authenticating users and verifying account access
  • Enforcing our Terms of Service and Acceptable Use Policy
  • Complying with legal obligations

We may use and disclose information as necessary to comply with applicable laws, regulations, legal processes, or governmental requests; to enforce our Terms of Service and other agreements; to protect the rights, property, or safety of Fenceline, our users, or others; and to respond to claims that content violates the rights of third parties.


ARTICLE IV: HOW WE SHARE INFORMATION

Section 4.1 Sharing Between Platform Users

4.1.1 Customer-Contractor Sharing

When Customers engage with Contractors through the Platform, we share Customer information (name, contact information, property address, project specifications) with the Contractor to enable service delivery. Contractors receive access to Customer Data solely for the purpose of providing services to the Customer.

4.1.2 Contractor-Supplier Sharing

When Contractors order materials through the Marketplace, we share Contractor information (business name, shipping address, contact information) with Suppliers to facilitate order fulfillment.

4.1.3 Customer Account Portability

Customer accounts are portable across Contractor websites powered by the Platform. This means Customer account credentials, contact information, and account preferences are accessible across the Fenceline ecosystem to facilitate this portability. However, project-specific data and communications remain associated with the specific Contractor with whom the Customer engaged and are not shared with other Contractors.

4.1.4 Data Boundaries

We maintain strict data boundaries between users:

  • Contractor-to-Contractor: Each Contractor's business data (customer lists, project information, pricing strategies, financial data) is kept confidential and is not shared with other Contractors.
  • Supplier Pricing: Supplier Pricing Information is confidential and is only disclosed to specific Contractors with whom the Supplier has established a business relationship. Pricing information is not shared with other Contractors or competing Suppliers.

Section 4.2 Service Providers

We share information with third-party service providers who perform services on our behalf, including:

  • Cloud Hosting and Infrastructure: Providers that host our Platform and store data
  • Satellite Imagery Providers: Services that provide property imagery for fence estimation
  • Payment Processors: Services that process payment transactions
  • Communication Services: SMS providers, email services, and push notification providers
  • Electronic Signature Providers: Services that enable contract signing
  • Analytics Providers: Services that help us understand Platform usage
  • Customer Support Tools: Services that help us provide customer support

These service providers are contractually obligated to use personal information only as necessary to provide services to us and to maintain appropriate security measures.

Section 4.3 MCP Integrations

When you connect third-party services through our Model Context Protocol (MCP) integrations, we share information with those services as necessary to enable the integration. This may include sharing data with:

  • Accounting platforms (such as QuickBooks)
  • CRM systems (such as Salesforce)
  • Communication platforms (such as Slack)
  • Government permit portals
  • Vendor ordering systems

You control which integrations are enabled and can disconnect them at any time. Your use of connected third-party services is subject to those services' own terms and privacy policies.

Section 4.4 Business Transfers

If Fenceline is involved in a merger, acquisition, sale of assets, bankruptcy, or other business transaction, your information may be transferred as part of that transaction. We will notify you via email and/or prominent notice on the Platform of any change in ownership or uses of your personal information, as well as any choices you may have regarding your information.

We may disclose information when we believe disclosure is necessary or appropriate to:

  • Comply with applicable laws, regulations, legal processes, or governmental requests
  • Enforce our Terms of Service, Privacy Policy, and other agreements
  • Protect the rights, property, or safety of Fenceline, our users, or others
  • Detect, prevent, or address fraud, security, or technical issues
  • Respond to claims that content violates the rights of third parties

Section 4.6 Aggregated and De-Identified Information

We may share aggregated or de-identified information that cannot reasonably be used to identify you. This information may be used for industry analysis, benchmarking, marketing, and other business purposes.

We may share your information in other circumstances with your consent or at your direction.


ARTICLE V: DATA RETENTION

Section 5.1 Retention Periods

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, or reporting requirements. Retention periods vary based on the type of information and purpose:

  • Account Information: Retained while your account is active and for a reasonable period thereafter to enable account recovery and comply with legal obligations
  • Transaction Records: Retained for at least seven (7) years to comply with tax and financial reporting requirements
  • Communications: Retained while your account is active and for a reasonable period thereafter
  • Usage and Analytics Data: Typically retained in identifiable form for up to two (2) years, then aggregated or de-identified
  • Security Logs: Retained for at least one (1) year for security and fraud prevention purposes

Section 5.2 Post-Termination Retention

Upon termination of your account, you have thirty (30) days to export your data through the Platform's data export features or by submitting a request to support@fenceline.ai. After this period, we may delete your data in accordance with our retention policies, subject to legal retention requirements. If your account was terminated due to fraud, illegal activity, or material breach of our Terms of Service, we may delete your data immediately and retain information necessary for legal proceedings.

Section 5.3 Deletion Requests

You may request deletion of your personal information as described in Article VI. We will delete or de-identify your information within a reasonable timeframe, subject to:

  • Legal retention requirements
  • Legitimate business purposes (such as maintaining security records)
  • Technical limitations
  • Information that has been incorporated into aggregate datasets that cannot identify you

ARTICLE VI: YOUR RIGHTS AND CHOICES

Section 6.1 Account Information

You may access, update, or correct your account information at any time by logging into your account settings. You may also contact us at support@fenceline.ai for assistance.

Section 6.2 Communication Preferences

You can manage your communication preferences as follows:

  • Promotional Emails: You may opt out of promotional emails by clicking the "unsubscribe" link in any promotional email or adjusting your notification settings. Note that you cannot opt out of transactional or service-related communications.
  • SMS Messages: You may opt out of promotional SMS messages by replying "STOP" to any message or adjusting your settings. Standard message and data rates apply.
  • Push Notifications: You may disable push notifications through your device settings.

Section 6.3 Cookies and Tracking

Most web browsers accept cookies by default. You can usually modify your browser settings to decline cookies or alert you when cookies are being sent. Note that some Platform features may not function properly without cookies.

Section 6.4 Data Export

You may request a copy of your personal information in a structured, commonly used, machine-readable format by using the Platform's data export features or by contacting support@fenceline.ai.

Section 6.5 Account Deletion

You may request deletion of your account by following the instructions in your account settings or by contacting support@fenceline.ai. Account deletion is subject to the retention policies and limitations described in Article V.

Section 6.6 California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):

(a) Right to Know: You have the right to request disclosure of the categories and specific pieces of personal information we have collected about you, the categories of sources from which personal information is collected, the business or commercial purpose for collecting or selling personal information, and the categories of third parties with whom we share personal information.

(b) Right to Delete: You have the right to request deletion of your personal information, subject to certain exceptions permitted by law.

(c) Right to Correct: You have the right to request correction of inaccurate personal information.

(d) Right to Opt-Out: You have the right to opt out of the sale or sharing of your personal information. Fenceline does not sell personal information as defined under CCPA.

(e) Right to Limit Use of Sensitive Personal Information: You have the right to limit the use and disclosure of sensitive personal information.

(f) Right to Non-Discrimination: We will not discriminate against you for exercising your CCPA/CPRA rights.

To exercise these rights, please contact us at support@fenceline.ai. We will verify your identity before processing your request. You may also authorize an agent to make a request on your behalf.

Section 6.7 European Privacy Rights (GDPR)

If you are a resident of the European Economic Area, United Kingdom, or Switzerland, you have additional rights under the General Data Protection Regulation (GDPR) and equivalent local laws:

(g) Right of Access: You have the right to obtain confirmation of whether we process your personal data and access to that data.

(h) Right to Rectification: You have the right to request correction of inaccurate personal data.

(i) Right to Erasure: You have the right to request erasure of your personal data in certain circumstances ("right to be forgotten").

(j) Right to Restriction: You have the right to request restriction of processing of your personal data in certain circumstances.

(k) Right to Data Portability: You have the right to receive your personal data in a structured, commonly used, machine-readable format and transmit it to another controller.

(l) Right to Object: You have the right to object to processing of your personal data in certain circumstances, including for direct marketing purposes.

(m) Rights Related to Automated Decision-Making: You have the right not to be subject to decisions based solely on automated processing, including profiling, that produce legal effects concerning you or similarly significantly affect you, except in certain circumstances.

To exercise these rights, please contact us at support@fenceline.ai. You also have the right to lodge a complaint with a supervisory authority in your jurisdiction.

If you are located in the EEA, UK, or Switzerland, we process your personal data on the following legal bases:

  • Contract Performance: Processing necessary to perform our contract with you (providing the Services)
  • Legitimate Interests: Processing necessary for our legitimate interests (improving Services, security, fraud prevention), where not overridden by your rights
  • Consent: Processing based on your consent (marketing communications, certain cookies)
  • Legal Obligation: Processing necessary to comply with legal obligations

ARTICLE VII: DATA SECURITY

Section 7.1 Security Measures

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, and destruction. These measures include:

  • Encryption of data in transit and at rest
  • Secure authentication and access controls
  • Regular security assessments and monitoring
  • Employee training on data protection
  • Incident response procedures

Section 7.2 No Absolute Security

No method of transmission over the Internet or method of electronic storage is completely secure. While we strive to protect your personal information, we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

Section 7.3 Data Breach Notification

In the event of a confirmed data breach involving unauthorized access to, acquisition of, or disclosure of personal information that poses a reasonable risk of harm to affected users, we will:

  • Notify affected users without unreasonable delay, and in any event within timeframes required by applicable law
  • Provide notification by email and/or other means as required by law
  • Include information about the nature of the breach, categories of information involved, and recommended protective steps
  • Notify relevant regulatory authorities where required by law

ARTICLE VIII: INTERNATIONAL DATA TRANSFERS

Section 8.1 Data Location

Fenceline is headquartered in the United States, and personal information we collect may be transferred to, stored, and processed in the United States or other countries where Fenceline or its service providers maintain facilities.

Section 8.2 Transfer Mechanisms

If you are located outside the United States, your personal information may be transferred to countries that may not have equivalent data protection laws. Where required by applicable law, we implement appropriate safeguards for international data transfers, such as:

  • Standard Contractual Clauses approved by the European Commission
  • Other transfer mechanisms approved by relevant data protection authorities
  • Your consent to such transfers

By using the Platform, you consent to the transfer, storage, and processing of your personal information in the United States and other jurisdictions as described in this Privacy Policy.


ARTICLE IX: CHILDREN'S PRIVACY

The Platform is not directed to children under the age of eighteen (18), and we do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18, we will take steps to delete that information as soon as possible. If you believe that we may have collected information from a child under 18, please contact us at support@fenceline.ai.


ARTICLE X: THIRD-PARTY LINKS AND SERVICES

The Platform may contain links to third-party websites, applications, or services. This Privacy Policy does not apply to third-party services, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party services you access through the Platform.

When you use MCP integrations to connect third-party services (such as QuickBooks, Salesforce, or Slack), your interactions with those services are governed by their respective privacy policies.


ARTICLE XI: DO NOT TRACK SIGNALS

Some browsers offer a "Do Not Track" (DNT) feature that sends a signal to websites you visit indicating that you do not want to be tracked. There is currently no accepted standard for how to respond to DNT signals. At this time, we do not respond to DNT signals. However, you can manage your cookie and tracking preferences as described in Section 6.3.
